General terms and conditions

1 Scope

and the Customer (hereinafter referred to as “Customer”) for the purchase of our goods are exclusively governed by the following General Terms and Conditions (hereinafter referred to as “GTC”) in their version valid at the time of the order. Deviating provisions only apply if they have been confirmed by us in writing.

Our offer is aimed only at consumers. A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose which cannot be attributed primarily to their commercial or independent professional activity (see §13 BGB).

2 Offers and conclusion of contracts

(1) The internet presentation of our product range does not constitute a legally binding offer. It is merely a request for tenders. The availability of an article is checked and confirmed by us in each individual case when an order is made. By clicking on the button “Buy now” the customer places a binding order on the items in the shopping cart. The customer may change or delete the items placed in the shopping cart until the dispatch of his order.

(2) The contract is concluded if we confirm the customer’s offer contained in the sending of this data by a separate acceptance declaration by e-mail or if we do not object to the offer within 24 hours. The declaration of acceptance vis-à-vis the customer is in principle also included in the delivery of the goods. An order confirmation by e-mail serves only to inform the customer that the order has been received and registered. It does not constitute acceptance of a contract.

(3) The contract text sent to you by email with the order confirmation.

3 Prices and shipping costs

(1) The prices stated at the time of the order are valid. All prices include the legally valid value added tax. Shipping costs are not included in the prices and are, unless otherwise stated, to be borne by the customer. Further information on shipping costs can be found in the offers.

(2) In the case of deliveries to countries outside the European Union, additional costs may be incurred in individual cases which are not the responsibility of the Seller and which are to be borne by the Customer. These include, for example, the costs of transferring money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in connection with the transfer of money if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

4 Delivery

(1) The shipment is made by a transport company of our choice. Standard deliveries are delivered from our delivery warehouse within a maximum of five working days within Germany and outside Germany within a maximum of 10 working days to the delivery address specified by the customer when ordering, unless otherwise stated in the offer. Delivery is thus made no later than five working days (Monday to Friday, excluding public holidays) or 10 working days after the payment order has been placed with the transferring credit institution or after the conclusion of the contract.

Partial deliveries are permissible and can be set off independently if this is reasonable for the customer and he has an objective interest in the partial delivery.

(2) Should a shipment of goods be returned to us due to non-delivery, the customer shall bear the costs for the return shipment as well as the costs for a new shipment.

(3) Operational disruptions – both in our company and in that of a supplier – in particular strikes, lockouts and all other cases of force majeure, do not entitle us to terminate the contractual relationship.

5 Payment

(1) Payments are accepted according to the payment options offered in the shop. However, we reserve the right not to offer certain payment methods for each order and to refer to other payment methods.

(2) In the event of factual reasons such as late payment, we reserve the right to continue to deliver only against advance payment.

(3) If the customer is in default of payment, we shall be entitled to charge default interest at the rate of 5% above the base interest rate announced by the European Central Bank p.a. If we have demonstrably incurred a higher damage due to delay, we are entitled to assert it.

(4) The assertion of rights of retention or set-off with counterclaims of any kind, regardless of the legal grounds or any other deduction, is inadmissible. This does not apply if the counterclaims have been legally established or are undisputed and claims of the customer in connection with the assertion of a statutory right of revocation are thereby excluded.

(5) However, the purchaser is also entitled to retain the right of retention due to counterclaims arising from the same contractual relationship.

6 Reservation of title

The delivered goods remain the property of Jolie GmbH until full payment has been made.

7 Guarantee

The statutory provisions on warranty of defects apply. Information on any applicable additional warranties and their exact terms can be found at the product and on special information pages in the online shop.

8 Liability

All claims for damages against us as well as against our vicarious agents are excluded regardless of the legal grounds, unless they are based on:

in the event of injury to life, body or health

in case of intentional or grossly negligent breach of duty

in the case of a guarantee, if agreed, or

insofar as the scope of application of the Product Liability Act is open.

In the event of breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on which the customer is entitled to rely regularly (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, with which the typically has to be reckoned. Claims for compensation for damages are excluded.

9 Right of withdrawal

Cancellation policy

You have the right to withdraw from this contract within 14 days without giving reasons. The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post, phone call or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification on the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation:

If you withdraw from this Agreement, we shall reimburse you for all payments we have received from you, including delivery costs (except for any additional costs arising from your choice of a different type of delivery than the cheapest standard delivery offered by us), without undue delay and within 14 days from the date on which we receive notification of your withdrawal from this Agreement. That’s what happened. For this reimbursement, we use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; under no circumstances will you be charged for this refund. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any event not later than 14 days from the day on which you inform us of the cancellation of this contract.

The deadline is respected if you send the goods before the expiry of the 14-day deadline. You will bear the cost of the return if the delivered goods correspond to the ordered goods. In the event of a complaint due to defective delivery, the return shipment is free of charge for you. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, characteristics and functioning of the goods.
